(NYSE:IMN), the new imaging and information company recently spun off from 3M, was successful in protecting the trademark rights for its industry-standard Matchprint brand color proofing system versus Seiko Instruments, U.S.A. Inc. "Upon learning of a proofing software product sold under the name "Matchpoint" by Seiko, Imation contacted Seiko, expressing concern that Seiko's brand would create confusion within the graphic arts, prepress and printing industry," said Chuck Oesterlein, vice president of Imation Printing and Publishing. "Because Imation's Matchprint brand color proofing system is the worldwide standard for single-sheet contract proofing, Imation felt strongly that such confusion would harm the Matchprint brand." Seiko declined Imation's initial request to stop using
the Matchprint brand. Imation then filed a trademark infringement action
against Seiko. In response to Imation's action, Seiko agreed to stop all
use of the "Matchpoint" brand worldwide. Imation will continue
to offer its Matchprint brand color proofing products. | ||
